An Avalanche of Product Liability Lawsuits Could Put Bayer Out of Business

Tens of thousands of Essure and Roundup herbicide lawsuits could put Bayer Inc. in the red for years to come

Monday, August 20, 2018 - One of the amazing things about the Republic of The United States is that its free market and legal systems often hold a negligent company accountable for its wrongdoings when federal government bureaucracies fail to do so. German pharmaceutical giant Bayer Inc. is finding that out the hard way. The company has been forced to discontinue sales of its once wildly popular birth control device Essure largely due to the lack of demand for the failed product. Bayer rationalizes their decision to pull Essure as follows: "This decision is based on a decline in U.S. sales of Essure in recent years and the conclusion that the Essure business is no longer sustainable. Essure is the only FDA-approved non-incisional form of permanent birth control," Bayer said in a statement. "The safety and efficacy of Essure have not changed." Nowhere does Bayer address the reason for the Essure sales decline other than to say it was due to inaccurate adverse publicity.

The truth of the matter is that over 35,000 women are members of the Facebook group Essure Problems and have posted chilling accounts in excruciating detail of their experiences having actually used Essure. The list of Essure problems is staggering but include being bedridden with blinding pain, migraine headaches, full body rashes, allergic and autoimmune abnormalities, heavy bleeding and much much more. Over 300 fetal deaths have been attributed to Essure.

When the FDA caught wind of the magnitude of the women's problems the agency promptly slapped tighter restrictions on the sales Essure. Such restrictions require a doctor and their patient to fill out a questionnaire proving they understand Essure's benefits and potential problems. Bear reports that the sales of Essure have fallen over 90% making the Essure business model unsustainable.

What may be truly unsustainable is the company's ability to survive the avalanche of lawsuits currently around 16000 that claim Essure failed to warn them of the product's life changing side effects. In addition, Bayer faces over 5000 lawsuits from farmers, landscapers, and government maintenance workers claiming Bayer's newly-acquired Roundup herbicide caused their cancer.
