Bayer's Warning To Women About The Essure Device

Bayer's warning to consumers regarding the Essure birth control device stresses that the device, like a hysterectomy, is permanent

Monday, April 2, 2018 - For years the Essure birth control device was marketed to women around the world as not only an effective form of birth control but also a reversible one. In other words, as an integral part of family planning. The company said that should a woman decide at a later date that they wished to become pregnant, the device could be removed. This has turned to be untrue. Over the years experience has proven that the device usually becomes so encased in scar tissue that nothing short of a complete hysterectomy could possibly remove it. Thousands of women experiencing unbearable pain caused for one reason or another by the device have been forced to have the Essure device surgically removed and their dreams of one day having a family ruined. Many women are choosing to sue Essure's parent company, pharmaceutical giant Bayer for damages.

What is Essure?

According to the company website, www.essure.com, the Essure birth control device is a soft, flexible, spring-like device that is inserted into each fallopian tube. Synthetic fibers surround the device in order to create irritation and encourage the formation of scar tissue. During these first three months, women are advised to continue their previous forms of birth control and give it time for scar tissue to form around the device and create a barrier to prevent a man's sperm from reaching a woman's eggs, thus preventing pregnancy. The company now stresses that the birth control device should be viewed as permanent a radical change in their marketing approach. Essure received FDA approval in 2002 and since then has been sold to over 3/4 of a million women. One of the selling points to a woman is that implantation of the device is painless and can be done in their doctor's office and without surgery or anesthesia. In addition, the company tells a woman that the device is non-hormonal and that the majority of woman return to their normal lives in a day or two. The company boasts a 99.3% effective rate in preventing pregnancy.

In addition to their product description, the company now adds a significant product warning at the top of the home page that warns doctors and women that the device can, "perforation of the uterus and/or fallopian tubes, identification of inserts in the abdominal or pelvic cavity, persistent pain, and suspected allergic or hypersensitivity reactions." The warning goes on to state that should the device need to be removed a surgical procedure will be required. Women contemplating using the Essure birth control device are also warned to tell their doctors if they are taking immunosuppressant's or have a history of allergic reaction to the components of the device, "polyester fibers, nickel, titanium, platinum, silver-tin, or stainless steel." Essure lawsuits will not be class action lawsuits where those filing a claim can expect to receive only very small settlements. Each Essure lawsuit claim will be handled on its own merit and each plaintiff will receive compensation in accordance with the individual damages they suffered.
